Emergency 2007

Emergency has been put onto the Nation of Pakistan as on 3rd November 2007. The move is done for freeing the Judiciary from people who have a bit of integrity left in their bones. There are some people condemning Emergency and they are in majority and are quite loud. There are some people on Musharraf's side but they are generally silent. And there are some people who say, what the heck? Emergency has no affect on my life so what do I care.

Surely if you have enough money to take your dear ones to private rather than government hospitals where the number of patients is far greater than the number of beds then you don't need to care.

Surely if you have enough money to travel by car or taxi rather than travel in over crowded buses with space for just one hand and one foot, then you don't need to care.

Surely, if you have enough money to hire the services of the best lawyers to present your cases in the courts, where by the way you being right will not matter, then you don't need to care.

Surely, if you have enough references and links in the government to protect you from goons, land mafia, bhatta collectors etc, then you don't need to care.

Surely, if you have enough money to send your children to private schools, rather than government run schools where there is no furniture and no teachers, then you don't need to care.

Surley, if you have enough money to rent or own a house in that part of your city where there are no gangs and no gang wars and your children can play around in the neighbourhood happily and safely, then you don't need to care.

Surely, if you can ensure that such luxuries, as mentioned above, can be passed onto your children as well, then you don't need to care.

But as for me, I believe that the continuous mis-representation of the section of Pakistani society who wants to live the Islamic way of life, is going to give birth to further extremism and further deterioration.

I believe that now Lal Masjid, May 12 and Oct 18 carnages in Karachi will have no convictions and they would eventually become parts of dusty dossiers.

But it does not matter what anyone of us believe and how happy or sad we are with whatever is going on. I believe in the court which is much higher than the Supreme Court, where the Judge, Jury and Executioner is the same. In whose courts you cannot lie as the prime witnesses will be your hands, your eyes, your feet. In whose courts there can be no NROs and no deals. Where the poor will be equal to rich and powerful. For they are the heavenly courts of Maalik-e-Yaum-Deen (the Maalik of the day of the judgement). Over there cases such as Lal Masjid, May 12 and Oct 18 carnages will be disposed off in just a few seconds.

Sometimes I wonder that maybe Allah has allowed the killers to escape punishment in this world and have few more days in sunshine. For no court or ruler of the world can execute a punishment which equals their crime. The crime which is the brazen Massacre of Innocent People.

All of you, who do believe and do care, worry not, since that day is not far, when Justice will be done and truth will prevail.

How Pakistan elects a president

The president of Pakistan is elected in a secret ballot by the two chambers of the national parliament (the National Assembly and Senate) and the four provincial assemblies.

In total, 1,170 people are eligible to vote. But not all votes are of equal weight.

Each of the four provincial assemblies has a total of 65 votes even though only one of them, Balochistan, actually has 65 deputies. This is so that each provincial assembly has an equal say in the election.

North West Frontier Province (NWFP) has nearly double that number of deputies, 124. So, under a formula to weight their votes, roughly two votes cast in NWFP for the same candidate will be counted as one actual vote.

There are five candidates in the running for the presidency: General Pervez Musharraf, Faryal Talpur, Mohammedmian Soomro, Makhdoom Mohammad Amin Faheem and Wajihuddin Ahmed.

Position of parties

More than 170 opposition members have resigned from the different assemblies in an attempt to discredit the election.

The National Assembly includes 60 seats reserved for women and 10 seats reserved for Non-Muslims.

The Senate includes 17 seats reserved for women and 17 seats reserved for technocrats and Muslim clergy.

The Members of the National Assembly are elected for a term of five years whereas the Members of the Senate are elected for a term of six years, with staggered elections every 3 years.

Nawaz Sharif's Exile & Re-Exile

Nawaz Sharif visited the elders of Tableeghi Jamaat in Raiwind, while he was still in power. He asked them make dua for him to stay in power so that he may serve Islam. The elders asked him to make Pakistan ‘Interest Free’, since its an open violation of Islam and as per Quran and Hadees, a ‘war’ against Allah and his Prophet (peace be upon him). Nawaz Sharif said that he cannot do so. The elders replied then you may not remain in power for long as people at war against Allah and his Prophet (peace be upon him) cannot be victorious. Nawaz Sharif was removed shortly in a coup by Pervaiz Musharraf in a game of political chess, when the knight decided to upgrade himself to King.


How much hand the statement of the elders played in his removal depends upon the level of faith you might have, but Nawaz Sharif, while being in power was no saint. He openly violated the rule of law to make his base stronger and/or to fill his pockets and that of his cronies. The medals on his uniform contains amongst others the following.


  1. He arranged a raid of his party workers on the sacred Supreme Court, which was hearing a case against him.

  2. The buying of judges for removal of Chief Justice of that time, Sajjad Ali Shah.

  3. The dollar account freeze after Nuclear Tests. But only for normal citizen. Him and his friends took out and bought dollars a day/night before and made huge amounts of money as the dollar price soared up.

  4. Removal of duty on luxury cars for 1 day. Which was a day when the luxury cars of his close ally Saif Ur Rehman were to arrive in Pakistan.

  5. His official vacation, on state expense, with his cronies and family to America with luxuries such as Limousines and Five Stars. After seeing their vacation, which even a Saudi Prince would envy, the Western Media rightly noticed ‘Is Pakistan a poor country?’.

  6. In the end of his tenure he was trying to become ‘Amir Ul Momineen’ and having a system of Royalty rather than democracy, with power remaining within Sharif family.

  7. Finally fresh from the confidence he had after removal of the Chief Justice through bribes and a military chief General Jahangir Karamat he tried to do the same with General Pervez Musharraf. Little did he know that the Pakistan Army had other plans.


Thus a coup was organized by the Punjabi dominated Pakistan Army for the Urdu speaking Army Chief who was still in air, showing the depth of loyalty the Army had for its chief. Nawaz Sharif was removed with the country almost nearing bankruptcy. He was sent to jail with loads of cases against him and his brother.


As the story discloses itself lately, prison life was far too much for him and with Zulfiqar Ali Bhutto’s example fresh in his mind, he might have cracked. As now truth discloses itself, he arranged through his friends, to contact the Saudi Government through Lebanease politician Rafiq Hariri, who was on good terms with the Sharifs, to intervene and arrange a safe passage for him. A request was sent to Musharraf to release the Sharif family and send them on exile to Saudi Arabia. Pakistan, as a country, nation and government, is so indebted to Saudi Arabia that Musharraf couldn’t say no. He agreed to a 10 year exile for the Sharifs and sent them to Saudi Arabia.


Immediately the Sharifs and their workers vehemently denied any such deal or agreement had taken place. They kept on shouting that they were sent to Saudi Arabia by force. This stance of theirs continued till just a few days ago. When the newly empowered Judiciary gave a verdict in his favor and rejected the legality of any such document. Incidently Sharif’s lawyers told the Supreme Court there there was no such agreement.


Nawaz Sharif decided to return back to Pakistan and overthrow Musharraf. This resulted in the, till now secret, negotiators of the deal to come forward, arrange a press conference and request Mr. Nawaz Sharif to abide by his agreement. They showed the whole world a copy of the agreement, on which Mr. Nawaz Sharif had signed. In a tit for tat press conference Nawaz Sharif, agreed that there was an agreement and that it was only for 5 years and not 10 years. Nawaz Sharif had lied to his supporters and public.


Anyhow in the wake of Supreme Court’s verdict, Nawaz Sharif decided to land in Pakistan to gain political mileage. Vary of his declining street support after the arrest of his wokers, he decided to leave behind his brother Shabaz Sharif. On arrival, he was allowed entry in Pakistan and the pending cases against him, were opened once again.


After this, there are 2 versions. One from the Government and one from Nawaz Sharif. The truth might be revealed in sometime.


Nawaz Sharif’s Version

Nawaz Sharif was sent to Saudia Arab forcibly. He chose the option of Jail. PML (N) would file an application against the government in the Supreme Court for contempt of Court.


Grary Areas: (1) No mention of involving Saudia Arab in the case, which is a party in all that has happened. So much so that Shabaz Sharif has openly declined that he would even involve the Saudi government if he files a case in the supreme court. (2) No answer as to why the Sharifs lied to his workers and on media. And why can’t he be lying once again? (3) No answer to the contempt of court committed by their lawyers, when they told the Supreme Court that there was no such agreement between the Sharifs and the government of Pakistan and Saudia Arab. (4) Why no contempt of court application filed by Shabaz Sharif when he tried coming to Pakistan and was sent back?


Government’s Version

Nawaz Sharif was allowed entry into Pakistan as per the orders of court, so there is no question of contempt of court. On arrival, he was given the option of Saudia Arab or Jail. He chose to go to Saudia Arab.


The government’s position is pretty awkward, since now the Courts (because of the action against the Chief Justice) and media (because of action against media in the Supreme Court and May 12 crisis) are against them. Therefore the government is countinously being or at least being tried to be painted as a villian. The courts, if the case appears in front of them, would have to decide what is the position of a written promise given by Nawaz Sharif to Saudi Arab to stay there for 10 years.


Some of the truth has appeared in this story of ‘The Exile and re-exile of Nawaz Sharif’ and some truth is pending.


In the end, I would come back from where I started, with the addition of a Hadees of our Prophet (peace be upon him), whose central theme is, ‘Your Rulers are nothing but your actions’. So if our actions are good and as per Islamic Principles then we would have good leaders otherwise craziness would prevail, be it Musharraf, Benazir or Nawaz Sharif.

Women 'Protection' Bill

A bill was passed by the Parliament of Islamic Republic of Pakistan. It was and is known as 'Women Protection Bill'. It was launched with great fanfare and after it was passed from the parliament and the senate, the 'Moderate' and 'Enlightened' president of Pakistan General Pervaiz Musharraf signed it. It was projected as the 'Victory' of moderate and enlightened forces in Pakistan. People who followed the time line of this bill and the various clauses in the bill, would definitely disagree with this notion. And if you can analyze the new bill carefully, it would just appear to be either a marketing or a Anti-Hudood campaign.

What is Hadd?
Hadd if simply defined, is the Islamic punishment, which has been set by Allah and communicated through the Glorious Quraan, and Sunnah of our Prophet (peace be upon him). e.g. In case of robbery, the hand of a robber will be cut away. In case of a large robbery, one hand and one leg of the robber will be cut, in case of Zina, if the person is married, then 'Sangsaar' (i.e. burying the body of the person except for the head, and then stoning the person to death etc).

These punishments though harsh in front of the world, but as Muslims we believe that since they are Allah's commands therefore they cannot be challenged, changed or modified. People who are unhappy/disagree with these punishments are in fact unhappy/disagree with the Quran. An act which is exactly the same as Kufr. Since Quraan and commandments of Allah and HIS prophet (peace be upon him) are to be accepted and followed in full and not in part and parcel.

Also mechanisms to prove the crimes which results in Hadd punishments are quite strict, e.g. in case of Zina. 4 witnesses of the crime are required before 'Sangsaar' can be done.

Please also note that a very popular clause of Pakistani Constitution is 'No law, which is contrary to Holy Quraan and Sunnah can be passed in Pakistan. Nor can such a law exist in Pakistan'. Therefore any such law is also against the constitution of Pakistan.

Hudood Ordinance
In the times of Zia Ul Haq. A committee of Ulema was formed to incorporate Islamic Mode of Punishments into Pakistani Law. These laws were written down and were known as Hudood Ordinance. It was mentioned in Hudood Ordinance, that crimes which cannot be proved through evidence mentioned in the Holy Quraan cannot get the Hadd Punishment. e.g. if for the crime of Adultery, there are no 4 witnesses, then the Islamic Punishment of 'Sangsaar' cannot be awarded to the criminal. In such a case, if other kinds of Circumstantial Evidences e.g. 1,2,3 witnesses, DNA tests etc, are present, then the judge can award other kinds of lesser punishments, as he deems fit. The law for this lesser punishment is known as 'Tazeer' and the law for the Islamic Punishment is known as 'Hadd'.

History of Women Protection Bill
It would be prudent to mention the history of the propoganda mechanism employed before the passing of this bill. About 4-5 months back, GEO News (a local news channel), started a massive campaign. Putting up sign boards and dedicating precious air time in challenging and asking people to think whether Hudood Ordinance can be changed or not. On their website the comments (edited I am sure) of various Islamic Scholars were present. Most of the credentials of the 'Islamic Scholars' were dubious but those Scholars who were renowned for their knowledge and not-for-sale personalities, were of the opinion that only those portions of Hudood Ordinance can be changed which were created by man i.e. Tazeer.

Various talk shows were arranged in which Islamic and not so Islamic scholars were invited to comment on these laws and somehow the one single purpose of the whole show was to make the renowned and conventional scholars to just say that the Hadd laws can be changed. Needless to say no recognized Aalim or Islamic Scholar agreed to changing of Hadd laws. And if for sake of argument someone accepted as well, then it can be assumed that he went against the Quran and Sunnah and therefore the dubiousness of such a scholar can be ascertained.

After some time a bill was prepared and submitted in the parliament by Chaudary Shujaat Hussain. The writers of this bill are not known till today. The religious alliance (MMA) rejected the bill immediately, since it was making some very crucial changes in the Hadd punishments and hence was against the Quraan and Sunnah. The ruling party, PML (Q) could not think of passing the bill since the ruling coalition required votes. The help came from another secular party PPP, which once was the sworn enemy of Musharraf, but lately have become the apple of his eyes.

The media projected this event as the Mullah going against the Protection of Women and started a massive hate campaign against them. The headlines of Daily Dawn were shocking to say the least. The news items presented in Dawn contained sledging journalism rather than objective journalism. People were confused since the media completely blacked out the clauses which the religious alliance was shouting against. Nobody knew the contents of the 'Women Protection Bill' either. Hence the General Public did not know the clauses of the bill which were under argument.

People in the ruling PML(Q) who had an iota of faith inside them, agreed to consult the non-political Ulema. The names of two, based on their unbiasedness and knowledge were suggested and agreed upon immediately (by all concerned parties, except for PPP). The two were Mufti Muneeb Ur Rahman and Mufti Taqi Usmani. The latter being a retired judge is quite experienced in Pakistani Law as well.

The two studied the major clauses of the bill and presented some changes in the Bill. It was agreed by all concerned parties that these clauses will be incorporated in the bill. The signatories, besides the Ulema, included Chaudary Pervaiz Elahi and Chaudary Shujaat Hussain and some key members of MMA.

The two Ulema also noted that the Bill even after the changes will be useless and it does not do anything to guarantee protection of Women against crimes which are prevalent in the rural areas of Pakistan. The lands of land lords from Punjab and Sindh.

Therefore the Ulema recommended some more areas to be covered. e.g. Marraige of Women to Holy Quraan should be banned. Karo Kari should be banned etc.

All was settled. But it seemed that the 'Moderate' president of Pakistan was against any changes in the bill. Why ? No one knows. PML(Q) probably fearing losing Musharraf's vote of confidence and PPP wanting to gain his confidence formed an alliance to gaurantee the passge of the bill. The Ulema asked for appointment from the President to tell him of the gravity of going against the commandments of Allah, but they were not given time.

Eventually the bill without the recommendations of the Ulema was forced on the parliament. The 'Moderate' president of Pakistan asked all 'Moderate' and 'Enlightened' forces of Pakistan to unite and ensure that this bill is passed.

The bill was passed through a majority vote. In doing so, the parliament went against the constitution of Pakistan. And brought a useless law into place which didn't guarantee anything for the women.

Clauses Against Quraan and Sunnah.

I would like to present some of the clauses which are against the Quran and sunnah.

1. A person who has committed Zina Bil Jabr (rape) cannot be awarded the Islamic Punishment of 'Sangsaar' or 70 lashes even when the complainant has brought 4 witnesses with him/her.

2. Islamic law does not allow changing of Hadd Punishment, once awarded, even by the Prophet (peace be upon him). But now Hadd punishments can be over ruled by the Provincial Governments.

Conclusion
It can be easily ascertained that since the 'Women Protection Law' does not cover some of the gross inadequacies which are being committed against women in the interiors of Punjab and Sindh, not by Mullahs and Ulema but by Land Lords who maintain their strangle-hold on Pakistan, therefore it has nothing to do with 'Women Protection' and has been presented for some other hedious reasons, amongst which can be, distribution of combined opposition, fight against Hudood Ordinance, bowing to the whimps of Europe and America.

The forces which are announcing their loyalties to 'Moderate', 'Enlightened' and 'Sub Say Pehlay Pakistan' camp are forces which are prepared to go against Quran and Sunnah. These camps have been created by President Musharraf and wants people to forget about religion or keep religion as a personal rather than a collective agenda.

These forces, by using Negative Propoganda and For Sale Media and Journalists, are leaving no stone unturned to malign Islamic Principles, Islamic Law and Islamic Scholars.

These are very hard times for all of us. Already news of people getting fired from Air Force, PIA and other government runned institutions because of having beards.

It is required for all of us to unite on Quraan and Sunnah. Make every effort to understand it from people who have knowledge of Quraan and Sunnah. And protect our Imaan, since these forces will do everything to take our Imaan and Jazba from us.

Meanwhile a committee of Non-Political Islamic Scholars have been formed by the name of 'Tahaffuz-e-Hudood Allah' committee.

May Allah protect us all from such a propoganda. Who knows what this has in store for us in the future.
